I will be contacting Apple concerning the logo within the next couple of days; that said, various other works on the net are infringing by your loose definition of Apples copyright term "Look and Feel". Now, just because they are doing it doesn't mean I should break the law as well, but if giving a nod to another work's ingenuity is breaking copyright law...
