Im real new at litestep and ive been experimenting, workin out how things work by modifying a theme iv downloaded and ive just about turned it into a new theme, looking complete different. Can I upload this, do i have to email the creater of the original theme? or what?

you should at least give credits to the author of the original theme. if you've just modified so it is still recognizable as the original, you should ask the author for permission.

Considering that you are so uncomfortable about just posting it...I would def. email the author.
